Charges in French Pass dive accident

Date: 1/10/2000

The Occupational Safety and Health Service (OSH) has laid charges in relation to the diving accident that occurred at French Pass on 10 March this year.

The charges were laid under the Health and Safety in Employment Act 1992 in relation to the safety of the six trainees who were undertaking dive training, three of whom died.

Charges have been laid against Nelson Dive Centre Ltd, the company doing the training and also the course instructor, Andrew Stuart. The court case is expected mid-November.

In August the police decided not to lay charges because their investigations could not find sufficient evidence to substantiate criminal negligence under the Crimes Act against the dive centre or the instructor.
